ReplyCautionary tale: I’m a retired attorney. Had a woman come in one day and told me her son was being charged with conspiracy to commit murder and needed a lawyer to help him. She had been shopping around. Short story, her 17 y.o. son is at a party and is suppose to call her when he wants to come home. She’ll get him. But instead he finds a guy who says he’ll take him and his 2 friends home. On the way, the guy and his buddy sitting in the front say they need to buy some things from a convenience store. They actually rob the place and kill the clerk in the process. Before they get 10 minutes from the store the police stop and arrest them all. As all of the attorneys before told her, there is nothing she can do for her son except to try to get a plea deal for the least amount of time in prison.
Regardless of the actual law, apply it to a jury. How do you convince them that he wasn’t involved? No jury would ever buy that. And by going to trial a judge will give a stiff sentence. Best bet is to plea bargain for a reduced sentence. (Yes, juries in the US are that dumb and yes, any judge if they value their career will let a case like this go to trial for the jury to decide).
Simple dumb mistake that any one of us could easily have made. You never know. And I’ll be there are millions of Americans who agree with me.
