Re: Apple lawsuit by DOJ. Anti-trust laws used to place a big emphasis on whether or not there was a “competitive” marketplace. Now anti-trust laws are based on whether or not there is consumer harm due to the fact that there isn’t a competitive market. The problem with that stance is that by de-facto they government is OK with a monopoly as long as there isn’t evident consumer harm. By the time this happens, it’s way, way too late. We can thank Robert Bork and others, for creating the legal framework for this shift in US anti-trust laws.
