    Some people just don’t understand use of force and the natural history of our world being evil. Maybe we should actually educate our children on proper self-defense and basic firearm safety regardless of where you live. I think that would have a net positive on society. Individual responsibility all the way. And I’m sorry, but I don’t get scared for my life just because someone is black.

    You can tell by some of the cheering that either people aren’t told the whole story at rallies, or there’s a lot of people who support self-identified vigilantes. Not necessarily done in self defense, but even with the idea that they were the ones that brought the deadly force into the equation. Promoting vigilantes was a very dangerous decision years ago, and I’m really shocked more people didn’t see that coming. Even after decades and decades of Police who historically expressed a hard “No” to vigilantism.

    This is a poorly-researched video. For starters, no, “stand your ground” was not invoked in George Zimmerman’s defense, and that’s easy to Google. It’s telling that Oliver’s team didn’t even do that much. Oof.

    what’s shocking is how these guys had clearly thought through in advance how to murder people and get away with it. they had researched the legal cases, knew to call it in themselves, and had practiced what to say during the call. they were looking to murder someone, it was just a question of time when they got their opportunity to do it. if it hadn’t been these victims, they would’ve found someone else instead.

    Tired of these mother f ers saying oh well that’s a bad example of it. What on earth are people thinking. Why do we say it’s ok to attack people doing anything at all. There is no reason to use a gun for this let alone shoot to kill. It’s stupid logic to say they are putting your life in danger. Carry a knife or something and defend yourself but no reason to shoot a projectile at someone. That tells you that they are far enough away to avoid them or prepare yourself.     Referring to the previous segment on the full episode:
    Imbalance is right. Under Netanyahu there has not been a year where MANY more Palestinians have died than Israelis.
    It’s all well and good to say “just don’t fire rockets and we won’t fire back”, but Palestine has offered a cease fire, which Israel has declined, so… they offered to stop. “We won’t fire back” is clearly BS.
    Israel has a right to defend itself. They also have a right not to wage genocide against Palestine.
    They are right now planning a ground invasion into Palestine – an unprovoked invasion that is NOT self defense.

    most people in our country do not eat fertilized eggs. But on the topic of abortions, many cultures (probably even some that will eat fertile eggs) believe that simply the act of contraceptives is murder. …or at the very least, immoral. One is to be fruitful and multiply. Preventing the egg from fertilizing, ether by using medication or a condom is reckless. Masterbating is wrong because it involves spilling your seed, wasting potential life. “Every sperm is sacred.” And if a woman is doing anything other than being a baby factory, that too, is also morally and ethically wrong. So just because a fertilized embryo may not be considered murder to some, there are crazy people out there who not only believe that it is, but also that a woman in the work place is just as criminal.

    Rights will always be abused and it is horrific when it occurs. I grew up in Southern Missouri and was shot at when I was 16, my friend was struck but it wasn’t life threatening.

    Farmers here store tons of fuel on their farm for their farming equipment they buy when it’s cheap and store it as gas prices fluctuate and it saves them a lot of cash over time.

    We have a bad meth problem here and people frequently break into these farms, cut the locks off the tanks, and siphon off the gas and resell it for cheap to fund their drug addiction or some do it just to make some quick cash.

    Well locks and barbwire will not deter anyone but a shotgun will. Not knowing if you have the legal right to defend your property is a bad situation if you are in their shoes. If they do not defend their property it will be taken and they will lose their livelihood because they eventually won’t be making any profit and run out of resources.

    The laws we have here ensure they can use lethal force to protect themselves from getting killed or being robbed blind. Calling 911 doesn’t work as they are gone and if they happen to get caught it’s 3 hots and a cot for a while and then they do it immediately after they get out.

    The problem occured when we got lost hunting and strayed onto some property right near his fuel storage site. We saw the lights in the house turn on and went over to talk to them and all he saw was someone going from his fuel storage carrying coming something coming towards him.
    Without the state laws we have here and the protection for gun owners I could have had him put in prison. If it was say New York. But he had every right to do that it is his land, his property, his livelihood, and his family. Even though it was a misunderstanding in a lot of cases it isn’t and here at least it’s frequency is enough it would harm many people if we did not have that law.

    Most people who go through the effort to legally purchase a firearm are responsible people and the few that abuse their rights doesn’t mean we should lose that right it’s simply more dangerous for a lot of people to not have a gun than it is to have a gun.

    It’s like freedom of speech a lot of awful things can be said or written using the rights of freedom of speech. Racism, information on how to manufacture explosives, radical or cult ideologies that cause terrorism or harm lives but it is the cost of having those freedoms. Everytime someone does something good with freedom of speech we take it for granted everytime someone does something bad we wonder if we should have that right. This is the same for all our rights and I can make a negative case for almost any right we have here in the USA.

    Ultimately, I think the US has a vigilante problem. Some people want to be the hero and save the day, so they go looking for trouble, thinking ‘That guy is doing a crime and is therefor bad and deserving of whatever happens to him’. Which is usually BS. The whole problem is summed up fairly well by Batman: a wealthy billionaire who wants to protect his city, but instead of using his vast fortune to combat the societal issues that lead to crime, he spends billions on punching poor people in the face because it feels effective. Does he round up the occasional psycho? Absolutely. Be he also terrorizes and provides free traumatic brain injuries to desperate poor people and addicts, all while undermining the authority of the legitimate law enforcement system which just makes the problem worse. Vigilante justice isn’t often justice. That’s why we strive for the Rule of Law, not the Rule of Might.

    Shooting some burglars robbing your neighbor might make you feel like a hero, but those burglars aren’t some random npc or comic mook with no connection to anyone or anything else. Connections like families that now have to pay a bunch of money to bury their sons/husbands/fathers and now are probably made vulnerable by their absence given the lifestyle of the dead men. Were they abusive to their families? Who knows? Certainly not the would-be ‘hero’ who intentionally created a scenario where he could shoot them and ‘save the day’.

    Heck, I think the whole concealed carry thing is partially based in the ‘hero’ culture. After all, if you were openly carrying the bad guy might target you first, preventing you from saving everyone. Or worse, might even decide to go do crime elsewhere where you can’t be a hero even in death. That death by fistfight gone bad could have been avoided entirely if the one man hadn’t been hiding a weapon. Or better yet hadn’t had one at all. Then they might both have some injuries and spend the night in jail for being dumb, but most likely both would live.

    Because if everybody, literally everybody had a gun and the right to use it based solely their current sense of personal security irregardless of actual circumstances… people are going to get shot. A lot. And the rest of us will live in constant existential distress.

    What if you were afraid of your life because you were mentally ill? What if I hallucinated somebody doing something terrifying, and blew their head off? Perhaps my mental illness developed after I bought the gun. Or a poorly funded background check produced no reason I shouldn’t have a weapon. The law says you just have to be scared for your life.

    You do realize Mr. Oliver, that twenty of our fifty states now have “Constitutional Carry” which simply means you can carry a gun, open or concealed, without any permit whatsoever. Just go to the flea market, buy one and strap it on. Seriously, I think you should do that sometime as a special segment. Perhaps you can find an elephant gun that will fit your budget.

    Her story is bs and stand your ground laws wouldn’t change the false narrative of her story in anyway. If she was about to be assaulted by a group of 4 people, regardless of whether they have weapons or not, merely pulling her weapon would either cause them to run/drive away or attack her in a hope to get the gun away from her before she fires. In one scenario she is defending herself, in another scenario she is murdering people running away from her. Stand your ground, does not and never has meant you are allowed to kill someone because you felt threatened at one point in time. No police officer would charge her of a crime for brandishing a weapon when she felt threatened.

    The police and prosecutors need to start prosecuting cases where there is clear evidence the deceased were retreating, because while stand your ground is essentially that you don’t have to avoid conflict, if the other party chooses to do so you don’t get to be judge dredd. If the laws are so poorly written that there’s even the question of being able to prosecute someone who admits to killing the other person and there is clear evidence the other person was retreating (such as being shot in the back) then our legislature’s need to go back to work and redraft them and create a much more narrow corridor.

    Good video, any law that work out from a subjective threat and not an objective one needs fixing.
    But again LastWeekTonight drops it by doing poor journalism, trying to push a racist narrative with statistics that blacks are 281% to be found the aggressor in stand your ground cases.
    But if LastWeekTonight really want to go down into those statistics they should hold that up against the percentage of violent felons committed between the different demographics in US, and you will se that it balances out.

    I don’t typically comment on videos, but I have to say I had no idea that my home state of ND enacted a Stand Your Ground law this year, and I am completely disappointed in our state government for enacting it. I am a gun owner, have a concealed carry permit, and on occasion carry when I am out and about. When I took my concealed carry test, one of the topics the instructor covered was when you can and can not use lethal force. ND was a state where if you COULD get away from the situation, you HAD to. The ONLY time lethal force was warranted was a “you or them” situation. He described a scenario where someone could be actively stealing the rims from your vehicle and you would not be able to use lethal force unless that individual decided to attack you. That has always made 100% sense in my mind – Ones possessions are not worth anothers life. I had a lot of respect for my state for not being a part of the “shoot first, ask later” mentality. Super disappointing.

Let them steal and you’re the victim then. There is no point in “feeling sorry” for criminals, they acted by their own will, so they knew what they deserve for by doing it. If somebody try to screw over federal organisations then they have the right to defend themselves and their property, so why normal citizen can’t protect what he/she owns…

    set aside all the examples given for or against. What do the stats say? How many stand your ground incidents are there a year? How many deaths? How many are justified? Without numbers, it’s all speculation and play on people’s emotions.
    You end up criticizing a law based on fear perception by appealing to your audience’s emotions.

    Are we just going to make judgement calls like that? They’re thieves. They could have also been armed. They could have also shot and killed people who got in their way.

    I don’t know the specifics of that situation with the old dude, other than the autopsy report says they were shot in the back, and I don’t know if he should’ve shot them or not. I wasn’t there. Maybe it was unjustified and he was just trigger happy. Who knows

    But it concerns me that everyone is bending over backwards to assert that human souls are worth more than furniture, like they personally know these guys. Nah, man. Some people are trash. And if you’ve committed to breaking into someone’s home to steal stuff, my first thought isn’t, “Hey, yeah, let’s make this person a victim and sympathize with them”

    Joe Horn actions are a difficult situation for John to debate against. Shooting people committing theft is perfectly acceptable to millions of people.

    A better solution, decriminalize drugs so the cost of narcotics drops to almost nothing. Then thefts to pay for drugs will drop to almost nothing. Then killing people for committing thefts will drop to almost nothing.

    That being said. If the person I shot is dead. And there’s no video showing what actually happened. Then it’s my word against a dead guy that has no voice 💀

    Some years after I left law enforcement I had a concealed carry permit. In all those years I pulled my weapon only once.
    My wife and I were in a mall when a laser dot appeared on her chest. Now when I was a cop, lots of people threatened to seek revenge and you never really forget about it.
    I pulled my weapon, turned and assumed a firing position. Over the sights was a kid about 12 years old. He was aiming a laser pointer at her. They panicked and ran. I put my pistol away and we left in a hurry. That’s why I stopped carrying for good.

    Brandishing a weapon is worse than shooting one. I know its odd but it needs be said. That’s probably why the person got some time in jail. So really shoot if your gonna shot just don’t brandish a weapon or fire a warning shot. Both will make things worse for than if you just shoot someone most of the time

    Wow. I’ve heard of SYG laws but never looked into them. As pro gun and self defense as I am I am totally with John on this one. This could apply to the kids that carry realistic looking air soft guns in my neighborhood. Someone could shoot a kid and get away with it because they were “fearful”.

    Yeah, the Horn Case should have resulted in the guy going to jail for double homicide. Stand your ground means stand your ground, it doesn’t mean deliberately seek out people to shoot and kill because you got a tiny dick.     I can already tell this is some bullshit taking a small subset of bad events to try to convince sheep that defending your life from a violent attacker (which in overwhelming cases is why you stand your ground) is reason to remove stand your ground laws.     Had to look up that story about the shooting at the bar over how big dogs can get. John Oliver makes it sound like the guy shot & killed someone over an argument about a dog and walked away. No surprise, he’s leaving out the rest of the story, which happened in 2018/19 so it’s not like it wasn’t already out there when this garbage came out. Both parties involved are fault, the guy who kill Scott Beary and claimed self defense was charged and sentenced guilty to involuntary manslaughter in the 1st degree. He was sentenced to 5 years in prison, where he currently resides. John Oliver, being the disingenuous, worthless pile of garbage he is, just decides to leave the story at that making everyone think that the guy walked away from killing someone.

    This is one of the few times when I disagree with John. I live in Louisiana where we do have a stand your ground law, as mentioned in the video. In college, I was a criminal justice major and one of the classes I took was a defensive tactics class. One of the topics we talked about was self defense. The teacher of the class was the head of training at the police academy. He had told us that initially he was against the law, but after thinking about it and hearing rationals for it, he changed his mind. He explained that if you encounter a threat in you yard, you shouldn’t have to retreat to inside your house to neutralized the threat. One thing he did say was that that the law didn’t extend to protecting your neighbor’s property. Why that guy wasn’t arrested, I don’t know. But I can tell you is that it wasn’t simply because he was white, as John insinuates. I don’t know if the law in that state is overbreadth in its definition of self defense, or what the case was. But it wasn’t because he was white and the other woman was black. Will there be flukes in the system and how the law is applied? Yes. No system is perfect and all we can hope for is that when we do run into one of these situations that straddles the line that the law is then tweaked to prevent such a situation from happening again. But to say that such laws are racist and all need to be taken off of the books in all states that have them is an overreaction and an over simplification of the whole situation. Simple answers to complex questions or situations is never the answer.

    Maybe the situations should be taken on a case by case basis. Maybe people prosecuted falsely are victims, and those who did the prosecuting should be held responsible. Maybe ridiculous victim speeches should be ignored. Maybe white Karen’s should be held responsible for their actions. Either way, you can’t take away people’s freedom to defend themselves. There are countless examples of guns being the great equalizer for women, minorities, and all Americans.

    Oliver didn’t state what those 2 robbers were stealing from his neighbor so I had to look it up. They were leaving the house with a sack of cash and jewelry. So this was not some insignificant robbery like for a PS5 as joked about in the video.

    From Wikipedia about the robbers:
    Torres and Ortiz were carrying a sack with cash and jewelry taken from the home of Joe Horn’s next-door neighbor. Both were criminals from Colombia who had been convicted on drug trafficking charges.[1] Police found a Puerto Rican man’s identification card on Ortiz. Torres had three identification cards from Colombia, Puerto Rico, and the Dominican Republic, and had been previously sent to prison for dealing cocaine. Torres had been deported in 1999.[6] Both were in the country illegally.[7]

    Apparently Joe Horn received death threats and the same for the district attorney who was deciding whether to prosecute him or not. He definitely shot some pretty nasty criminals. He probably shouldn’t have done that for his own safety. Who knows who you could be shooting? You could have drive by shootings at your house within hours if you mess with the wrong people. But anyway, I think this is why he was praised so much, as these were 2 pretty bad guys and he received a lot of flak from their criminal buddies too.

    I disagree with the statement that it is a “solution to a problem that didn’t exist.” This is ignoring that fact that things like armed robberies, rape, and murder exist. Stand your ground laws are way to broad and protect the wrong people and should be repealed but this is the shit reality that we live in. Can we legislate gun laws that protect people by allowing them to protect themselves? Are there too many gun is America that banning them outright would give too little protection to law abiding citizens and too much power those that don’t care? If I’m out walking my dog, and another much more aggressive dog starts attacking her, can I use lethal force to save her life (certain Stand Your Ground laws apply to property)?

    While I think the NRA is corrupt and horrible, I do think there are examples where you have no choice but to defend yourself. In my firearm classes we were taught to first try to defuse the situation verbally, or escape. Only as a last resort should you use your firearm. These are examples of people who need more training or just want to shoot someone. You should only shoot if you will lose your life or are in immediate threat of great bodily injury if you don’t. Not just because you think you will lose your life, but because you know you will. Interesting episode as always.

    He failed to mention Chicago… State of Illinois does not have a “stand your ground law” and yet Chicago shootings are rising higher and higher. NYC also does not have a “stand your ground law” and yet crime is on the rise. Maybe the “stand your ground” law should be federal law because I’m getting sick and tired of politicians tying the hands of law abiding citizens from defending themselves. It’s sickening when someone defends themselves or the life of their loved ones or an innocent victim being attacked, only for the defender to possibly be held liable, dragged through the justice system and possibly sent to prison and/or sued. This is so sickening. Of course the “stand your ground’ law does need to be re-defined obviously, because anyone can use that law to unjustifiably maim or kill someone in the name of self-defense. Stand your ground law must only be used if you have no other choice.

    Also this idea of “duty to retreat” is troublesome. So whoever came up with this “duty to retreat” is naïve, suppose you cannot retreat because you have a medical condition, old age, or just plain out of shape, do they actually believe that those people with physical problems and/or age will be able to outrun a young criminal or a gang of youths? How moronic is that? I swear, these people who are making these policies are so far removed from reality that they should all just go back to sleep and let someone with common sense come up with common sense solutions/policies that empowers law abiding citizens and take away the power of these criminals. I also believe that if any law abiding citizen is contemplating on buying a gun for protection, that they must undergo training in order to be licensed. They need to master their weapons and learn the rules of engagement that applies to the law “stand your ground” “Castle doctrine”. The training need to be extremely thorough, nothing like boot camp of course. But learn how to aim, hit a moving target, gun safety and when to NOT shoot, etc.

    This is such a dangerous situation, I have had family that have been threatened with a gun in broad daylight and in my safe suburban home just for walking to get home or waiting in a car. I can’t imagine what went in their minds but it makes my heart sink with fear and infuriates me to think people can cause so much trauma and stress with no good reason.

    Although not listed on Oliver’s show, California is also a “Stand Your Ground ” state. More correctly, state judges, not legislators, have ruled there is no “duty to retreat.” On a national level, some 38-40 states have no duty to retreat if in public spaces, meaning these states are “stand your ground ” states.

    Even among those 10-12 states that have a “duty to retreat, ” that duty doesn’t apply if a person is in their home, workplace, or car.

    We almost never hear about the gun killings and I’m glad that in my country very few civilians are allowed to carry guns, that too after getting proper authorisation and a license.
    Even the cops have to follow strict measures and have to give account of each bullet that they fire.

    16:00 one of the main rules of gun safety is that you ONLY aim a gun when you need to use it. It’s like arguing that “oh I only shot them in the leg cuz I didn’t wanna kill them” tells the court that you didn’t really fear for your life AND your only intent was to *maim*

    The uscca stuff, innocent people go to jail because they say the wrong thing and/or talk to the police too quickly. There’s a reason that the police themselves get isolated and instructed to not speak because ANYTHING YOU SAY *CAN AND WILL BE USED AGAINST YOU IN A COURT OF LAW* so let’s be real. Who in their right mind would open themselves up to being arrested for murder even if they did nothing wrong and the person they shot legitimately posed a threat to their life.

    Your 600 homicides a year stat. You don’t bring up the difference in crime rate between those places (with and without stand your ground). In other words, how many of those 600 homicides would instead be the shooter being victimized by the person they kill? Also, there are 331 MILLION PEOPLE in the us. *More people choke to death on their food per year (5,228 annual deaths.)*

    First off… before stand your ground you could not even legally pull your defense gun unless the person had a weapon. If you did you were going to jail of you got caught… so if 5 or 6 men came at a woman there’s nothing legally she could do unless one of them produced a weapon…there are many times when a mugger or other assaults have been stopped simply because a handgun was drawn and not shot being fired…these incidents you’ll rarely hear about because it’s over and both parties go their separate ways and its never reported…. This sernerio I know about… Try walking through downtown Jacksonville and you’ll be quite appreciative of this law …There is a good reason for this law….

    Yes there are stupid people out there that will try to abuse this law just as they do every law out there…But why should those few deny all the others that wouldn’t even this of doing it? Why should these people be left vulnerable?

Why is it so hard to understand that it is everyone’s right to be able to protect themselves and they are not the one’s in the wrong? Without these laws you can be sued and lose everything you have for protecting your family or yourself.     POS need to know someone is going to standup against them, not cower or run the other way. Have any of you guys been held up, or burglarized? Depend on the police to get there quick enough to protect you and you will be disappointed. They get there to fill out the report, not prevent anything.

    Even with stand your ground laws, any time there’s a “self defense” shooting they apprehend and treat the shooter like a criminal. They handcuff them, put them in a police car, and take them into booking. They sit in jail and wait for their court date (unless they post bail) like everyone else and then make their case to a jury at which point “stand your ground is invoked.” The jury decides if Stand your Ground applies, not the arresting officer. Even if you beat state charges (assuming they pursue them) you’re almost certainly going to have years of legal issues on the civil side.

    Contrary to what talk show hosts want you to believe, there’s a lawyer behind every bullet.

    Stand your ground and/or open carry if you are white. Gun laws are all about keeping control of power and when the wrong people try to use the same laws, they get arrested. I am not against guns; however, I can clearly see there is a racial discrimination around guns. Personally, I think concealed carry should be a citizen right and you don’t need to report to an officer you have one unless it has been fired. Another point, I don’t want concealed carry as a right until the government offers gun safety and maintenance classes as mandatory course in school. Everyone should know how to use and maintain a gun even if they never plan to own one.

    “Stand your ground” does not mean “shoot people you don’t like” or “shoot people who do things you don’t like”. Police officers are allowed to kill people because they are afforded public trust. Individuals are not afforded public trust, so they have no right to kill someone unless their life or the life of someone else is directly threatened and there is an indication of imminent danger. That goes for the woman in the beginning of the segment as well — pointing a gun at a car full of people because you don’t like what they said SHOULD get you arrested; that was not self-defense in any way, shape, or form.

    Thank goodness we have right to defend ourselves. There would be no need for stand your ground laws if good people defending themselves weren’t being criminalized by the same people crying about them. Same with the USCCA card. The only argument you have against them is that not every shooting is justified, and that will always be the case, and eliminating stand your ground laws will not change that. Get rid of stand your ground laws by making them unnecessary.

    I generally agree with you but the Prosecution of George Zimmerman was wrong. The jury got it right. He was justified to use deadly force against an assailant banging his head into concrete. Zimmerman has since shown he’s a terrible person but the way things played out, he was justified in shooting. He was following someone, with no real cause. But all he was doing is following. Does that mean he should allow the person to bang his head into concrete? Was the other person allowed to attack him and bang his head? No. It was tragic and Zimmerman is a jerk but he was ok to shoot someone who attacked him with actions that can cause great bodily injury.

The demographics of gun owners are changing and encouraging firearm ownership amongst minorites is only a good thing.     As a provider who does home health visits, and being black, I’m constantly afraid for my life. Especially in rural towns… trump counties. I was approached by a patient’s neighbor, who said that my kind is not welcome and then offered to “escort” me out of the neighborhood. She followed me to the free way. On the way to my next appointment in the same county, I drove by a house with a recently burnt cross in it’s lawn. This was in March 2021.

    Ok genius, you don’t just get to say you felt threatened and therefore were entitled to use deadly force. It doesn’t work that way. We don’t need spunky little Englishmen explaining something that’s over their head. You have to meet very specific criteria to use deadly defensive force. Innocence, imminence, reasonableness, proportionality and avoidance, which is the topic is here. If you fail to meet any of those legal standards, you can’t claim self defense, and it’s probably off to prison for you. Unfortunately, not a lot of gun owners know the laws, nor understand the responsibility and liability that’s involved in defensive gun use. Most people I wouldn’t trust with a potato gun. Personally, I’m against stand your ground. If you can avoid a fight you should. If you can and you don’t, then you’re just stupid. The avoidance element only applies if you can retreat safely without further endangering yourself or those you have a responsibility to protect. Hopefully it was only the two clowns arguing over the weight of a dog that got hurt. If so, that’s just natural selection and good riddance to both of them. Joe Horn is an idiot.

    I’m realy happy that we define selfdefence as the least violent method to defend oneself against an infringement of your rights or violation to your health.
    As it looks like in the USA self defence is the most violent method to defend oneself against an annoyance.
    Can you shoot Oil comapany CEO if they poluted your drinking water ? Is that considered standing ones ground ? Or does it only count if someone jostles while you wait inline in front of the Burger King counter?

    This is really difficult for me morally. As a citizen of the EU, I d say the ideal environment is to grow up without (easy) access to guns.

    But if its part of the culture already, its very difficult for me to have any sympathy for those robbers being shot. I mean they are ruining someone else s life. For all I care, they’re scum and the world is better for it getting rid of them. As a neighbour I d probably thank him.

And now in many of these same states it’s perfectly Ok to run over pedestrians who happen to be in the road. There’s something very interesting that a woman has managed to change state laws so effectively. I’m thinking about so many others who have done so on the side of good.

    He says the laws solve a problem that doesn’t exist and the only proof is the one lady that didn’t get arrested. Then later even with the law another lady that shouldn’t have been arrested did get arrested. Then she was released. Seems like they need to strengthen the laws or improve them since he literally listed an example where someone still got arrested. Without these laws she might still be in prison.

    Sorry John, but if someone is trying to break down your door at 3am with cars in the driveway they are very likely intent on harming or killing you to get what they want. There is no ‘de-escalating’ or ‘retreating’ from those kind of situations, which is mainly what Stand Your Ground laws were created for. They give you the right to stop the threat to your personal safety (and those around/with you) by using deadly force if necessary when criminals invade your home, workplace or vehicle. When they engage in this criminal behavior, their intent is unknown and should be presumed deadly (unless they demonstrate otherwise). Remember when seconds count, the police are only minutes away. That’s why we need Stand Your Ground laws to protect law-abiding citizens from criminals who violate their person and property.

    This is another case of well meaning bad analyses of a real problem. First people got frustrated because of all real criminal acts, (like trespassing, bodily harm and other crimes) that were being over turned. People were literally being told by law enforcement a person had to wait till bad guys were either literally in your house at least, (out side) so many feet inside your property line and still showing aggression against you or your family. Solution modifying older self defense laws instead of creating new law with just as many loop holes. One note. I’m a Demecat. I believe in 2nd amendment, (you also have to understand what it really means) I’ve been in a situation where I have literally had show a gun to protect two of my kids. Key word show, (and lucky that was all). Mental wellness is always put on back burner over extremists actions. Man who shot two at next door neighbors should have been thrown in jail. All his actions showed premeditation in his thinking.

    The castle doctrine has many caveats, like the stand your ground law, such as you can’t shoot someone if they are in your car and you are not, same with your house (unless others are there). The biggest point left out is with a castle doctrine if someone breaks into your home or car with you in it, legally it’s assumed that they intruder had lethal intent thus justifying legal, lethal, self-defense. Stand your ground laws offer no such assumptions/protections and legally speaking that’s a huge fucking difference.

    John, I have liked your program for years, however lately I think we are about to part ways. First off about the stand your ground rule, it is a good rule. You act like the criminals have rights to rob and hurt you. There are going to be situations which can be questionable, however being able to shoot someone who has entered your home or who is threatening your life is a good thing. A criminal will think twice if he knows he can be shot; same goes for raping a woman. Clearly your mind would have a change of heart if someone was to enter your home and beat you to a pulp and rape your wife. Your next purchase would be to buy a gun, which you should have anyway. Police cannot stop crime, they just clean it up.

    Israel has every right to blow the Gaza strip bad to the stone age. If the Palestinians do not want Israel to attack them, maybe they should quit shooting rockets at them. This scenario has played out time after time with people like you crying about how unfair it is to the people of Palestine, what a bunch of garbage. The second Israel calls a truce Hamas shoots more rockets into Israel. It sucks that people die, but that is the price of war. Wipe out Hamas and the problem is solved, which means a lot of people are going to be killed and rightly so… go Israel…

    I never liked the “run and hide” laws about self defense because in the heat of the moment, they usually fail miserably. As is usual though, the consequences of laws are not typically considered in the USA. These laws have obviously gone too far in giving people the ability to pick fights and kill people. One case that sticks in my mind is the Michael D Dunn case, where killer tried to use the states SYGL to avoid prosecution…It didn’t work in his case.

    Here in Michigan: I had to pull my pistol on 2 hillbillies after they fought with a bouncer friend of mine and I carefully tried to split one from choking the bouncer with his tie. I went for surgery on my toe the next morning from an unrelated issue, so fleeing wasn’t possible when they came to corner me alone. I pulled me firearm as they approached, cocked it (expelling the previously chambered round in the process) as a warning in case they were still charging thinking it was fake or didn’t notice itt… As I lifted to fire, I was quick mentally enough to notice the very moment they had second thoughts as I began to squeeze and I stopped and let my arm down without firing at the last fraction of a fraction of a second, the very moment the danger seemed to lessen.
    When the police arrived, I had to hand over my firearm for a month while the detective considered the case and made a decision whether or not to arrest me because, according to Michigan law, I would have been within my rights to shoot, HOWEVER, because I hesitated and looked for any reason not to kill, I had allegedly broken the law by brandishing a firearm. If they want to change a law. Make it legal NOT to shoot someone when they back down as you go to fire at them. I understand that not everyone is as sharp as me. When my adrenaline kicks in, time slows for me. For others it becomes a blur, so I would understand others not perceiving that last fraction of a second moment where the threat had subsided but it shouldn’t be illegal to change your mind.
    For the record, I was eventually explained to by police that I did in fact violate the law by not shooting and yes they did confirm that legally I had the right to fire and legally was not supposed to stop myself. The charges were never filed because the assailants declined to press charges after the club the incident happened outside of declined to press charges against them. No, I had not drank a drop of alcohol nor entered the club (that would bring different charges).
    Also, should be noted that, as a CPL holder, I walked into a gun store and bought another pistol while the police had my other one. I really expected my CPL to be temporarily suspended while police investigated or something but no such procedure exists.

    I expected the case of Amber Guyer to be mentioned. She just appealed her conviction for killing a black man in his own apartment as he watched TV and ate ice cream. She believed she had walked into her own apartment and the use of deadly force was justified. From the appeal in April 2021:

    Guyger’s lawyer, Michael Mowla, argued before the three-judge appeals court that Guyger’s mistaken belief she was in her own apartment negates “evil intent” to kill. A conviction of criminally negligent homicide, he argued, would be more appropriate.
    “Mr. Mowla, you’re overlooking the fact that Miss Guyger testified that she intentionally shot Mr Jean,” Chief Justice Robert D. Burns III told the attorney. Burns at one point suggested that Guyger’s conviction was in fact supported by the legal precedent raised by the defense.
    “I’m not overlooking the fact, your honor. I agree,” Mowla responded during the Zoom hearing. “She did intentionally shoot Mr. Jean because that was her intent. That was the truth. Those were the facts of the case. If she had walked into her apartment, and there was an intruder inside her apartment …. she would have been entitled to use deadly force in self-defense.”
    In the appeal, Guyger’s lawyers said that “her mistaken belief negated the culpability for murder because although she intentionally and knowingly caused Jean’s death, she had the right to act in deadly force in self-defense since her belief that deadly force was immediately necessary was reasonable under the circumstances.”

    I was very hesitant to watch this video because John’s views are typically too left wing for me, but I have to admit I think this video has changed my opinion. I always thought stand your ground had to do with self defense in your home. As long as the law’s that protect someone acting in self defense in their own home remain, and there is some type of common sense applied to people clearly protecting themselves in public I think I’d support getting rid of the current stand your ground laws.

    You criticize the stand your ground laws because they are based on one anecdote (you argue), then you argue against them based on one anecdote. Also, your criticism of the subjectivity of the reasonableness of fearing imminent great bodily harm is misinformed because the person’s fear must be objectively reasonable (i.e., it is an objective standard, not subjective). Further, one could always (in America) defend him or herself with lethal force if he or she reasonably feared severe bodily injury. What stand your ground laws do generally is remove the duty to retreat, and in some cases or states (e.g., Florida), create presumptions in favor of the user of deadly force that such use was reasonable under statutorily-prescribed circumstances. In some cases or states (e.g., Florida), part of what is considered the stand your ground law can also require the state at a stage prior to trial to overcome the presumption in favor of the user of force by presenting sufficient evidence (to show that a trial is warranted). It is clear you do not like firearms or laws designed to protect their lawful use, but it is also clear you do not accurately understand either. Consider having your team research statistics of the lawful use of firearms to prevent the commission of forcible felonies, which admittedly is difficult data to generate accurately because many instances of the use of firearms to prevent forcible felonies are not reported, and comparing them to the statistics of unlawful use. If you’re genuinely interested in debating the topic of firearms more objectively, that data should be part of the discussion. I like your show, which is why I think you can do better.

    To all of us in Europe, American gun laws seem strange. But that guy in Texas shot somebody burglarising a house, no? I, and I suspect a lot of other people who’ve been burglarised, don’t see much wrong with that. If the burglar hadn’t broken into somebody’s house, they wouldn’t have been shot. So I can get behind that guy. The laws themselves seem too subjective in most other situations though. Probably best to get rid of them. It strikes me that a lot of these gun nuts buy guns almost hoping that they can shoot somebody and use these laws to get away with it. That has to stop.

    That was my cousin that was shot in the Missouri bar. Scott was a great man and Father. Killed in a senseless crime. The murderer took a plea deal and is doing 5yrs in prison. Stand your ground laws should not be law in any state.

    Castle Doctrine however, is a law that should be law in every state. People have the right to protect themselves in their homes from criminals regardless if the criminal has a weapon or not. A criminal whos illegally broken into one’s home can be a threat to ones life regardless if the criminal is armed or not.

    @Helio  Perhaps, chat isn’t my preferred method of communication so I can ramble or easily end up on tangents, but these “stand your ground” laws seem more about justification of homicide than protecting those who truly must defend themselves. I work hard for my property yet I don’t want my neighbor to murder two people by shooting them in the back to defend it. Worst punishment for theft was having a hand, or two, chopped off. Too many are too eager to end the lives of others and that makes them more dangerous than the average criminal. For proven evil I have no issues with the death penalty, but that involves courts and the legal system not a nation full of Dirty Harry or Judge Dredd wannabes.

    The amount of misinformation and simple lies that can be conveyed in 19 minutes and 17 seconds is incredible. Where are your sources? Why is it that actual crime statistics disagree with everything you say? Why is it you think that a “conceal and carry” is necessary in any form other than arbitrary and illegal laws when the second amendment already guarantees the ability to “conceal and carry?” Why are you bringing up a bird in a monologue about laws and guns? Why is it okay to be racist about a white persons complexion? Why do you find it difficult to comprehend why someone who defended himself outside of his home would dial 9-1-1 while also wanting a friend/etc to call his attorney/USCCA to get legal representation for the obvious legal ramifications he will now have?

    Why is it that you keep referencing an argument about dog weights without even letting the news bit finish explaining what exactly led up to the shooting? I mean did the man who was shot simply push the other man and then get shot? Or did the man who was shot begin to physically beat someone who legitimately feared for his life? You already know the answer to that question though. Because the details were released. The person who was shot did charge at the shooter. And yes, it’s conflicted as to whether or not the shooter riled him up before hand. But that isn’t the point, because had the man who was shot not converted an argument with words into physical violence, he wouldn’t be dead right now. Also, the shooter DID face a murder charge for that incident. He was not found guilty after a jury hung and continued to plead guilty to the lesser charge of involuntary manslaughter for which he was sentenced to five years in prison. That occurred in 2019 and was found with a simple search, so I find it difficult to believe that whomever did research for this episode simply missed it. So congratulations on repeatedly bringing up a case that you thought was your holy grail of vicious defensive use left without charges being brought, but you failed. Just as you failed to actually do any critical thinking before saying half the shit you said here.

    Why is it that the CDC National Safety Council, you know the organization that all liberals now believe is the pandemic bible that can’t be questioned, stated in their report that defensive use of firearms prevents violent crime and murder at a scale of a minimum of 500,000 up to possibly over three million occurrences PER YEAR? -Or, for the sake of the simple minded, I’ll use the figures they put on their website which is between 60,000 up to over 2.5 million. Keep in mind that even including suicides gun deaths are approximately 40,000 per year. So guns save people AT LEAST as often as they are used to murder, even including self murder (suicide) which typically accounts for OVER HALF yearly, or 20,000+. If not including self-harm, guns stop 3x as much crime as they commit AT MINIMUM. Yet you want to take away the ability of people to protect themselves in public where they have every right to be and instead make it mandatory that they run away, which in itself they could be shot, stabbed or otherwise assaulted as they ran away. Why? Why would you do this to people? You do understand that 20k-40k is NOT a lot of people in a country of 300 million+ right? It’s slightly more than 0.01%. Even if every single one of those 40k killings were terrible, hateful crimes of the most heinous nature targeting the most underserved of our population it still wouldn’t register as an actual danger that many people need to be afraid of. You know which statistic WOULD register though? Violent crime. You know, the particular crime that guns help stop a minimum of 60k up to over 2.5 million? Yeah, that violent crime. 1.2 million occurrences of violent crime reported in 2019, and that’s just REPORTED. Just using that number we’re at 0.4% or over 40x more likely to be the victim of a violent crime than a victim of gun homicide/suicide combined. It’s actually insane that in the same breath you condemn the defensive use of guns while also advocating for reducing crime and saving lives.

    Since when have moral values been determined by which side suffers more? If you compare the British citizens who died in World War II compared to the Nazis – there were many more Nazi casualties. What distorted moral values do the world have that instead of examining why the war started, and why Hamas is firing on Israel – it is determined who suffers more? Why you didn’t talked about why Hamas is hiding in residential buildings and kindergartens, about the percentage of violence in Gaza against children and women, the violated human rights and the bodies of young Israeli they did not return to Israel.     Concealed Carry laws means everyone might have a gun, so there is a legitimacy to fearing anyone might pull a gun on you. Stand your ground laws means you are allowed to pull your own gun on anyone if you are afraid they are threatening your life. How could anyone foresee that this combination would cause a tragic unnecessary increase in homicides?

    Minor clarification: The petition was to change the FL state bird to the Florida Scrub Jay, a separate species from the Western or California Scrub Jay, which is much more common. The FL Scrub Jay is the only bird endemic to Florida. 🙂 I stumbled over that petition long after it had closed, but I too feel that the FSJ should be our state bird. Five states have the Mockingbird as their state bird, and it can be found all over the contiguous 48. : As much as I do like Mockingbirds – and I honestly do, I find their songs comforting, because they’re so familiar – I think the Florida Scrub Jay is far more deserving of the title, and the recognition (and protection!) that comes along with it.

During a domestic violence call to police, even if the woman was not hit and has no visible injuries, and the male is large and intimidating looking, the woman can claim he threatened and scared her and hell automatically go to jail for assault.
