    This is a massive problem with American capitalism. When everything is for profit, debt is the result.

    I consider myself so lucky that, as a 42 year old European, I have never needed to put things like healthcare or education on credit. Any country where the only option people have in bankruptcy in order to get through school or pay medical costs, is a failed country.

    The fact that that woman lost her son to CF is a testament to how bad the american healthcare system is. My little sister has a quite a severe kind of CF, she is now 23 and reasonably healthy. And for someone to die as a child because of this disease is as far as I know basically non-existent in the Netherlands.

    Off topic, how about a show about what happens if you try to live abroad as an American. I’m unable to properly prepare for retirement here in Europe because the banks wont touch us having U.S. citizenship. Also the U.S. government jacked up the cost of getting rid of your citizenship so poorer people like us can’t afford to get rid of something we never asked to have in the first place. I could go on and on about how the U.S. tries to punish people who chose to leave it’s borders but it would spoil your fun of discovering yourselves if you decided to pursue it as a story.

    has this show ever helped anything ever? every week they produce a very passionate exposé on some topic that needs addressing, but have yet to ever see any action or follow up on the progress of any changes. they are preaching to the people that would love to see these things fixed, but have little power to do so, so we’re just left to dream about what if these problems were resolved.

    Gonna point out that students take loans when they are 17/18 while having an incredible narrow view of what debts are when they haven’t even finished puberty. Some of them are advised to get a credit card (by their college’s financial advisors) to help them pay the debt, without telling these kids that this just shifts the debt. It’s a bunch of Bs

There are reasons for bankruptcy, but at the end of the day you’re borrowing money from someone, and not paying it back. it isn’t “a good thing”. Let’s all borrow money, and not pay it back – that sounds sustainable.

    So last year I filed for bankruptcy with a lawyer who specialized in discharging student loan debt in bankruptcy. Then he died in an unexpected and horrible event, and now I’m trying to figure out how to still do that. I finally found another lawyer that will do it, but only my private loan and for $6000! It sucks!

    I used to really like this show due to its depth and analysis, but lately, it’s been getting so woke that it’s becoming a parody. This video is literally telling you that it’s ok to be irresponsible with your money and rely on bankruptcy, and also makes all financial education sound bad. Normalizing poor financial decisions and bankruptcy is NOT what I thought this show would lead to years ago when I became a fan. Stop this victim mentality virtue signaling and go back to more objective, cool-headed deep-dives, please.

    making education more accessible and affordable

    The majority of bankruptcies wouldn’t happen if we had universal healthcare. Student loan debt would be minimised if state colleges and universities were tuition free.

    Both ideas have been championed by Bernie Sanders for years.

    Most of this makes sense but I agree with student loan debt not being dischargeable. Other debts come with backing collateral that can be repossessed or otherwise used to make the issuer of the debt more or less whole, and leaving them to hold the bag of any difference seems reasonable. But there’s no repoing what goes into one’s head. Making it not dischargeable is a reasonable consequence for getting access to that quantity of debt at low interest rates and few questions otherwise asked.

    Stop giving Biden a pass…he has made everything worse and is just an establishment politician. They do nothing. Why not simply change the law so people who recklessly run up debt are not eligible for chapter 7 or 13 a second time? Why do the responsible people in society get screwed, and I am including the people bankrupted by unforeseen medical debt or other horrible situations? Why not prioritize their cases? Sorry, just like people, not all college degrees are the same. If you were dumb enough to pay 50k in loans just to get a bachelors in psychology or anthro or some gender studies degree, you deserve what you get. Don’t go to college if you don’t have something you want to learn (unless your parents are paying for it or u have a grant). If you want to do yourself a favor, why not go into enginering or some other STEM field? Oh..because it’s too hard? Well, sorry, you will not get a return on investment for gender studies. Anyone logical can think or at least google and figure out, “hmm, how many gender studies jobs are there out there…there might not be any demand for me after getting out should I make this investment?” College loans should follow you til you die…period.

    I see Bankruptcy as something not for me because im poor. I have to admit, its annoying because most of the people filing for bankruptcy make ALOT more money than me, probably 5 to 10 times.
    If they lost everything they owned, which they don’t, and were forced to take a job making 1/10th their previous income, They would be as well off as most of us
    Maybe worry about the other 45% to 55%. ive never heard about anyone in my neighborhood filing bankrupsey

    Bankruptcy filings should be free, with attorneys getting a tax break for the value of a bankruptcy for each one that’s successfully enacted. For chapter 13, the tax break should come after the customer’s contract is paid in full.

The reason is, of course, that such a person should never have had such high levels of debt when times were good. If the person is unable to pay her debts in a timely manner when times are bad, this means she did not engage in proper financial planning and does not believe she has any responsibility to others.     My parents went bankrupt trying to pay for my dying brothers medical bills…he died at 12 and sadly my parents financial situation slowly improved only because he died….and people acted like my parents were lazy when they found that out.

    I remember when I was in an accident and saddled with 151,000$ in medical debt (Aetna managed to get out of paying about 94% of the bill). I tried to go bankrupt but needed 2,500$ to do so which I couldnt afford. This lead to when I needed a car, I had to take a loan with a 24% interest rate, ending up paying for 42K for a 21K car- almost perfectly double. Great system.

    If I understood it correctly, you can go bankrupt 2 ways in USA. By chapter 7 you lose everything and you have no debt, or by chapter 13 if you are able to pay all debths in 5 years and you can stay with some property. If this is correct, than it is heaven compare to situation in Czech Rep. Here is only distraint of debtor. Payee will hire a distrainer on debtor and he will take everything from debtor. But this process is without end. It stopps only if everything is repaid. But that is almost impossible, because to original debt is added something called “accessories”. That is payment for distrainer. It can be 1000$ for every bill in debt. (there was cases, when somebody didn’t pay 10 parking tickets and from original debt 50 dollars was 10050 dollars). This has also “small” interest 1% per day. Also your disclaimer can be on other side of the state and YOU have obligation to go to him and solve it. Of course you have no money in this situation. 🙂 Also disclaimer has no obligation to tell you, that he has your case. So he can wait 5 years (interest is growing) and he will inform you just before the debt can expirate by time. Distrainer also can go anytime to your home and take you anything valuable…
    Politicians are about 20 years talking about it – they feel, that this is may be not best process – but they didn’t change anything important. Poor payee can’t lose his money…

    Credit cards are high interest… People live beyond their means…
    People with student loan debt go to college for degrees without researching the job market first… The woman that you showed has a degree of science of global affairs… How many jobs are in that job field?
    I understand about the recession but I find it difficult to believe that the field she chose had a labor Gap… There is a lot of just plain stupidity or willful ignorance in America today which is ironic because in this day and age we have more forms of communication and information available to the masses than ever before in human history yet people continue to make emotional as opposed to rational decisions… And somehow our choices and poor decisions are always somebody else’s fault… Damn the ads and marketing no one is forcing anybody into a casino, to drink alcohol, to smoke cigarettes, or to get credit cards… I think Susie ortman is a hack but she really is on to something with recidivism on credit card debt… But hey everybody’s a victim right?     But do we want to make bankruptcy easier? 🤔 All of the examples that tug at our heart strings were really other issues. The kid that passed away needed free health care. The lady with the student loan debt needed loan forgiveness. There needs to be an overhaul of the system, but I would definitely hate to see it be easy and painless.

We may not have houses, families, or hope for the future but we can rest easy knowing escape from the crushing burden of debt is only ever a step (head first into traffic) away. 👍

    Unlike car loans or home loans, student loans have no collateral. Making them bankruptcy proof was a gift to lenders. All of the risk rests with the borrower, often young adults. These loans are poorly structured and predatory. I love Elizabeth Warren!

    I was surprised i did not hear anything about means testing., which means that if a person makes over a certain income amount set for your home state you can only file chapter 13 , which is often, in effect, worthless in many cases. Also poor people can often get help from a Legal Aid Society to file for chapter 7 for a much smaller amount than the fees he mentions in here. the other option is self filing, which if the person is well educated could mean paying the filing fee in bankruptcy court and taking the chance it could be cancelled due to an error. but its not rocket science and lawyers often use software which does all the work for them.

    Why should I pay for someone else’s student loan when I couldn’t afford it myself and climbed the latter in a small business instead . I have to pay Medical debt cause it was either I get it to live or I die in a year. Had kidney stones get 10 pain pills for the equivalent pain of a woman pushing a baby out for in my case months while a pill poper I knew received 60 a month for pain in in arm. I was stuck on the ground lose job while the other never worked and received gov benefit and women’s groups donations. I wish I had a lifeline like those. My white male privilege is extremely expensive decade old cat while she had a new Cadillac. I hate socialism and socialist healthcare because it’s people like me that must pay 70 percent of my income for others while my credit for unable to pay 5 years of income due to living in a a house without a floor. Happened in my 20s. So Naaaa. If I can make it then they can too.

    I find it so interesting how so many issues in the US are not issues at all in Sweden. In Sweden the government gives you the option of debt restructuring in exchange for you living at subsistence minimum for 5 years. Most people don’t even pay 50% of the debt when it is expunged like this. If your debt is from the government itself then you do not pay anything at all. I guess at that stage we consider the individual to be so lost without much hope to rejoin society as a contributor in the near future so we just force them to live below even the social security contributions. So setting it up is free and since the government can see everything, along with everyone else due to the principle of openness in Swedish law, they know if your income or expenses decreases or increases to know if you follow the plan. So it is fluid and you cannot cheat it.

    This way is generally accepted as the best option so it is not even an issue in any debate. Once you have gone into debt restructuring most social stigma of being irresponsible in soceity is removed, though the old banks of course never forget. Credit card companies are just as toxic in Sweden as in the US. In general the old banks in Sweden are extremly risk-averse, in part due to a lot of government regulations these days. So the old banks are more secure but less and less people get the option to loan from them at reasonable interest rates. New super high risk banks and ‘peer-to-peer’ lending pop up all the time to cater to the growing number of especially young individuals with bad credit scores that do not live up to the government standards. Probably as a consequence of not teaching basic economics and budgeting as part of the primary education.

    Fun fact, my student loans were so bad, I’ve left the country to get away from the payments that make it so I can’t live despite working a job full time in the US that paid me double the amount of minimum wage.
    To keep it short I left my own country to survive and unless private student debt all gets wiped I can never live in my home country again.

    Student loan debt should not be forgiven, nor eligible for bankruptcy.
    If you can’t pay for collage, simply do not go!
    Go to a trade school instead. Most people earn enough by the end of their education that they are literally being paid to learn the trade.

    Plus as long as there are vast numbers of stupid people cramming to get into collage like rats leaving a sinking ship for an even bigger sinking ship. There is no incentive to lower tuition. But an enormous incentive to raise it.

    “Work smarter, not harder” is how collages get more people to fall for their bull shit debt trap.

    So get a damn job. Make your way. And while you are doing that, buy the collage books needed for what you wanted to be. And study them in your free time. So when you do go to collage you are financially sufficient, and already know the material. Or most of it.

    Just don’t get side tracked by other peoples bullshit! You will have enough of your own to deal with.

    The REASON personal bankruptcy is stigmatized is because YOU stopped playing by THEIR rules. Rules that benefit THEM but totally exclude YOU. Many people stay in debt and live paycheck to paycheck due to obscenely high interest rates charged on credit cards. You get to the point where all you can afford to pay IS the interest.

    I hear it’s difficult to file for bankruptcy. When I was younger, I left an abusive marriage, got sober and found myself mired in debt. Instead of filing for bankruptcy, I scaled back on expenses, lived in a small apartment, drove a car until it was 10 years old, and worked 2 jobs while attending support groups. I paid off my student loans, and paid off my debts. I wasn’t able to buy my own home until I was over 50 years old, but I’m glad I did it this way. For families who are destitute and have devastating situations, I get that bankruptcy is probably their best option.

    I think the biggest draw is it needs reform with an end to lobbying and setting term limits. That would be ideal. Also we need a new form of bankruptcy titled hardship and keep chapter 7 for no control. Not everyone who is in debt got there from consumer spending but rather from other sources like medical, student loans and such.

    You need to discuss the packaging of credit card debt, etc., into investment vehicles through secularization, if you want to really understand why banks aren’t overly concerned about making sure their credit card customers are able to repay their credit card debt. Once the credit card debt is securitized, it is off the bank’s books. It is a gold mine for these companies. Credit card debt, auto loans, etc., any debt that involves a revolving credit line and limit by consumers or businesses can be securitized. It is incredible that it is legal and very lucrative for the lawyers and companies who create and use these options. It is a reason why all consumers need to be cautious with their debt load.

    Funny timing as I just had to file as a shady “dental company” that did horrid work and scammed me—and didn’t even finish the work—filed suit for a debt I finally gave up on. I was lucky as I nearly couldn’t afford to file before the suit and barely made it. A garnishment would have ruined me as it would have easily been too much for me to keep up on my rent.

    I worked hard to even get this apartment, working hundreds of hours in overtime so that I could get this place. It’s hard to find any apartments around here for under $800 a month, so this place was perfect—and newly built.

    Bankruptcy is not some archaic idea created by congress or some state legislature, it was put in the Constitution by the founders. Most things in our Constitution were put there in direct opposition to British tyranny and to codify the rights of citizens, bankruptcy being one of them. If you could not pay your debts in Merry old England, you went to jail. The founders wanted to decriminalize debt, so they allowed congress to create uniform ways for people to pay off or discharge debts they could not afford to pay. Bankruptcy laws allows people to come up for air instead of drowning in debt. It is not a perfect system but it is better than throwing people into Dickensian debtors prison.

    I remember when that BS bankruptcy law was passed. Democrats tried to add four exceptions to it, all of which were slapped down by Republicans. The three I remember were medical expenses, loss of job, and military service overseas. Yes, the party claiming to support the troops refused to allow an exception for soldiers who go into debt serving in the bullshit war they pushed for! That level of soullessness and the inability to see that anyone who would refuse such an exception is a terrible human being just boggles my mind.

    Seems like there should be a bankruptcy that allows a debter to say “I cant afford to pay off the debt with interest, please eliminate it.” In other words, have a bankruptcy that eliminates interest. You would still get a derogatory mark, but it would show that you want to make it right.

    I used to work in a bankruptcy firm as a legal assistant. One of the reasons why so many chapter 13’s get thrown out is because people would file to keep from getting their car’s repossessed, make payments until after their court date, and then stop. About three months of non payment and their case would get thrown out. Giving them three months at a reduced payment and three months where they are paying nothing. The dealers would try to come after the car again and they would come into to file again. This was a cycle we would see frequently.

The court appoints a “receiver”, as a “non-profit”, The NRA, is required FULL Disclosure, thus this bankruptcy going to expose donations, donors names, financials of the NRA, membership lists, salaries, expenses, political contributions….the NRA cannot survive a digging that deep into it.

    I don’t think college debt should be forgiven. I would be comfortable with interest on college loans being halved or removed as part of a bankruptcy program but not the original debt, what you agreed to take on for classes, housing, and whatever else at that time should remain your responsibility.

    Medical debts should be entirely forgiven as part of the government universal healthcare bill.

    Yeah, the mandatory credit counseling was joke. People would come in and we would get their paper work ready and then tell them to do the online course as soon as they left the office. As soon as the counseling company sent us their certificate, we would file.

    In the 1990s I had a paralegal business i prepared more bankruptcies than civil cases, divorces etc. I use the prepare 5 to 7 bankruptcy a week. I was charging $250 per bankruptcy . Then the lawyers stepped in and passed a law
    Basically destroying the paralegal business in california, turning our businesses into legal document prepares and made it nearly impossible and basically illegal holding the bankruptcy petitioner preparer illegally responsible for the documents they prepared. So now it is a legal risk a document preparer takes to prepare bankruptcy paperwork.
    Insane because paralegals or legal work paper prepares were taking money away from the lawyers.

    The argument of “Oh, the poor creditors, all these bankruptcies are hurting their ability to make money” is so asinine… Yeah, no shit, that’s the fucking risk you take when your business is providing credit. When your customers are taking on debt to you, you assume the risk that they will default on that debt. It’s your responsibility as the creditor to manage that risk and provide options to allow customers to repay that debt. If they can’t, then you just kinda have to accept it as the cost of doing business. That’s just how it works.

    For simple Chapter 7, for impoverished folks, it should be as simple as filling your short form taxes. You should be able to file it with an interview based software. If Intuit can help you file your taxes, someone should be able to do the same for bankruptcy. (I knowledge that this may already exist, but I’ve never heard of it.)

    Regarding Grassley, I’m from Iowa, and I remember the 1985 Farm Crisis and he was of no help to his constituents, while Harkin was a hero. So anything Grassley has ever said about bankruptcy is of no value, he’s just a mouthpiece for the debt holding industry. He’s been an embarrassment ever since he entered the Senate and the press labeled him as “Senator Dumber”. It’s ironic that he is firmly entrenched within the DC establishment swamp, yet he entered Iowa politics as a reformer. He’s no different, his grandson is in state politics; just another multi-generational political dynasty in the making.

    I believed, on his first day in the state legislature, he wore tall rubber boots, so he could wade thru the hog shit. What a hypocrite!

    I know everyone believes student loans cant be discharged through bankruptcy but they actually can be. I didnt have to file in the end luckily, but I graduated college in 2006 and when the 08 recession hit i was straight up fucked. Many say the 08 grads got screwed but nah, 07 and earlier did because we already had the jobs and debt, 08 couldnt find them. Anyway, Right before everything happened I had just bought a house (which I lost in the end), the car i had for 7 months also lost, back to my parents house, with phone calls all the damn time about bills. I wasn’t reckless like many others either. I had a career lined up before I graduated and was 1.5yrs into it when the country fell apart. The only debts I had was student loan, mortgage, car note, and 2 credit cards. Because I was stable I went and got that house. Yknow what, long story short, because of the utter fuckdom I was in with everything I went and met with a bankruptcy lawyer, and thats when I learned student loans can be discharged, and the myth that they can’t had been heavily pushed by schools, creditors etc for a couple decades, pushed so heavily that it became its own animal, a constant self reinforcing myth believed by everyone. Its actually rather simple, your lawyer just has to file some separate paperwork than the overall bankruptcy paperwork and only then will it be included in everything. Because I believed the myth also I went and met another lawyer who completely confirmed what the first guy said. He also said because everyone believes the lie pushed by the scumbags that noone ever thinks to include nor even mention it during a consultation.
    So guys, if in the end, you have no other choice at all but to file for bankruptcy, PLEASE REMEMBER to get your student loans included because THEY CAN AND WILL BE DISCHARGED.
    I really hope this helps as many as possible

    honestly, the reason you can’t discharge student loan debt is because without it, no 18yo would be able to get the loan to go to college. that said, college is an absolute shit-show, so maybe if banks stopped lending the $ to go, then people would actually just go out and get jobs instead of racking up enormous sums of debt?     When my late mom was in the hospital with a heart attack and no insurance, we had a financial representative from the hospital speak to our family. She said we have the right to examine all your assets and we will determine how to proceed. Things like selling your house and cars were mentioned as well as bankruptcy. We never said anything to our mom.

    I filed bankruptcy last year with my fiance and oh my god our lives improved so much. Seriously if you are over your head in debt like we were then and you can afford a lawyer then do it. If you can’t afford one you can still file on your own and there are resources out there to walk you through it.

    People declare bankruptcy because this US finance system is broken. Student loans, child support, and back taxes are some of the reasons for bad finances but people are really in this position because of inadequate salary on jobs, unemployment, high interest credit cards, and medical debt

    I think someone needs to get the word out that you can file for a fee waiver if you can’t afford the fee and are under 150% of the poverty level for your state. It’s a 20 question form, and most of the questions are very easy.

    I ALWAYS encourage my students to watch your show, it helps them in so many ways:
    1- Question everything they believe in to know if it’s true or NOT.
    2- Teaches them if something deserves to kiss ass or NOT.
    3- Improve their listening comprehension, sentence structure…etc.
    4- Give them a ton of real resourced information and knowledge.
    * 5- (A joke) British English is not that hard to understand LOL.

    these are bad examples to be crying over John. Most of these people just have spending problems. coming out of bankruptcy, you don’t get a card and max it out. the one crying about not affording bankruptcy, had money for cable and beer. I seen that interview. Don’t need a lawyer to file. The Radmilla story is her fault. no one told her to go to a private school. You go to where you can afford. I graduated around the same time Radmilla did and have no debt. You should be pushing for financial literacy instead of moaning about people who are bad with money. The only people I feel bad for are the ones who have hospital debt

    Last Week Tonight should do an episode on interstate movers. They quoted us under $3k with “guaranteed price matching” and charged us over $6.5k. They broke our stuff too but don’t just take my word for it, check the reviews for Mega Van Lines and Cross Country Movers. They are abysmal and their contracts are AWFUL!!!

    My father -in-law owned a small, country fuel bulk business meaning that he provided fuel to farmers and local gas stations. He was affected over and over by others going bankrupt. Most of them owned big houses which they were allowed to keep, nice cars (often luxury cars) which they were also allowed to keep, large farms which again they were allowed to keep, etc. The only one hurt was my FIL. People took money they owed him and spent it with out regard for their obligations. Spend it today; you can always go bankrupt tomorrow.

    I filed for Chapter 7 (perfect for me because I rent, drive an old car I paid cash for, and don’t have any assets) and my debt was discharged in early 2020. The biggest relief ever, especially when a few weeks later, *pandemic* and got laid off my job. Cost about $1800 between attorney and filing fees. The thing about not being able to afford it… I was surprised John didn’t address… when you stop making your credit card payments, then you have that $ to save up for a few months to cover lawyer fees. Of course that’s assuming you’re still making those minimum payments. That’s how it worked for me. For anyone who is in a similar situation, I recommend looking into it. Check out your local bankruptcy court–some have free sessions with bankruptcy lawyers where you can ask questions and get their advice on your situation.

    I was a slam dunk for Chapter 7 10 years ago. The attorney could not believe how little I was paying for services like trash and internet. I live frugally. I was pushed into bankruptcy by America Express. I was paying off a card (which I was no longer using), and every time I would make some progress, they would lower my credit limit by $2000, kicking up the percentage of credit used with them. This caused my credit score to plummet, causing other creditors to raise my interest rate and minimum payment, and along with some medical bills, forced me to seek bankruptcy. My revenge was I charged the attorney’s fee to the American Express card, and then filed the bankruptcy. I was able to keep my house, but not my car.

    This definitely is not going to be repeated. I am in a newer house now, my only debt is a car and house. I pay off credit cards monthly. Growing up poor definitely helps with life skills…

    When I filed bankruptcy years ago, it cost me 120$ to file because I didn’t use a lawyer during the proceedings, only someone who prepared the stack of 100+ papers needed. I was in the low end of the group that day as there were people with a million dollar filling of debt and NOBODY was there to contest it. The ONLY people that were there to contest a thing were other lawyers trying to implicate the person in the area that was preparing documents for us for around 100$ so we didn’t have to add to our problems with unnecessary lawyers. 🤣🤣

    The girl with the student debt sounded like that was her plan. Run up student loans, get her degree, then, haha,ha, declare bankruptcy and get rid of her student debt before using her degree to get a good job and start earning money. Unfortunately, that was the plan for a lot of people. Unsurprisingly, Student loans became harder to get and very expensive. That’s why the government made them nondischargable.

    Reminds me of a Supreme Court case, I believe it was US v. Kras. It was in the 1970s, and Kras couldn’t afford to file for bankruptcy. He had a kid with chronic illness, lost his job selling insurance because someone stole cash payments he’d received from customers. Pretty sure it was him and his wife, their two kids, then his mom and her kid in a 2 bedroom apartment. He petitioned the court to waive the $50 filing fee, and ended up taking it to the Supreme Court.

    The Court ruled against him, saying if he needed to file bankruptcy that badly, then he’d figure it out. To make it worse, Judge Blackmun said if Kras used the weekly payment plan of $1.92 per week, then that’s just the cost of a movie ticket and pack of cigarettes. You know, because everyone can afford to go to the movies every week.

    The US is an irredeemable disaster.

Elizabeth Warren’s statement is belied by Elizabeth Warren’s study of “medical bankruptcy”, which reported that loss of income due to medical issues was a much greater issue in bankruptcy than medical bills. Although it also reported that people filing bankruptcy had lots of problems, and that all of them might still have been bankrupt, even if they had no medical issues at all.

    Filing for bankruptcy when I was in my early 20’s was the best thing I’ve ever done from a financial perspective. My wife and I married when we were 21 and 18 and were not educated on many of the pitfalls that young people regularly face…such as medical bills. She began having seizures and needed to be taken to the hospital via ambulance a few times. We weren’t hip to the fact that ambulance rides cost like $5-10k! And that a 3-day stay in the hospital would be another $5k. We also didn’t realize that if you couldn’t pay your medical bills in full, that they would work with you on a payment plan that fits your capability. I was raised to believe that if you didn’t pay your debts, you went to jail. That’s why I think it’s crucial that parents discuss topics like credit and how it works with your teenage kids. It will matter and it will make a difference.

    This entire system is shit but let’s take a moment and think about this. If it was very easy to file bankruptcy and it got rid of ALL debts, including student loans, what does that actually mean? What does it mean if all these lenders cannot get their money back because everyone filed for bankruptcy? Would they still have a business to lend money to other people to offer them an opportunity for a college education? People get pissed, get angry, and get very narrow minded because of their own circumstances, but try to think through the entire process and see what the consequences will be. There are always trade-offs for everything. It’s not the bankruptcy system that is broken, it’s the price of everything here from education to medical to housing.

    One criticism here. As usual, there is a lack of statistics to provide context. Loans including to students to get any degree independent of the business case for that degree in the marketplace is a breakdown in banking, education, and ultimately a personal decision. One case presented has more to do with the problem of health insurance necessitating bankruptcy than with bankruptcy itself. Selective reporting of cases, anecdotal evidence, is one of the first warnings of fallacious thinking in any research methods class. The cases are true, but the question is are they typical of the class. No. There are other educational systems that provide testing and guidance to help a person find a fit and receive training in technical school or university for free while ensuring employability. If we eliminate debt and continue to fund education without any connection to individual skills or the current and future marketplace, the problem will continue and the middle class will be working to bail out Wall Street, Main Street, Skid Row, and taking care of their children, adult children, and parents and grandparents. A broken system breaks people. But, the outrage is not helpful because it suggests simple solutions to complex problems. The show starts to become to discussion of social problems what Jim Cramer is to investing. Sound and fury…

    I was 24 when I had to file for bankruptcy due to over $90,000 in medical bills. I didn’t have a credit card, had a personal loan so I could pay health insurance premiums, and was working full-time but wasn’t making a lot. Since my only asset was a small car, I filed a Ch. 7 bankruptcy, but I couldn’t afford the $1800 legal cost (because it’s literally impossible to file without an attorney). My wages were garnished for a year so that I could pay for it and my debts were discharged. I thought I was free!
    Little did I know that the condescending “debt education course” was only the beginning of the shame. I knew how to budget well and literally none of this debt was anything other than medical expenses! I didn’t realize that all apartment complexes and future employers would run credit reports and deny me just because of the bankruptcy. Even now, 3.5 years later when my credit is good (and I worked hard to get it to be “average”), they see that bankruptcy and won’t even let me explain why I had to file.
    I had no choice – bankruptcy was my only option at the time and I stand by that tough decision. I just hate that this will follow me for 7 more years on my credit report!

I like John Oliver and he’s usually pretty fair in his commentary but he’s by no means 100% truthful. “13 year old was unarmed when shot” . Yes technically true but he was armed up until one second from the shooting. The gun hadn’t even hit the ground from him dropping it yet.

    But the other side is declaring bankruptcy is like getting someone else to pay for the risk that you took, like choosing an education that cost 80k versus a community college. Is it right to dine and dash? Unless prospect of paying back is impossible, it’s not fair to the small restaurant owner. Any claims of free lunch usually involves someone paying. Never easy to look at it from the perspective of others when we have an interest that benefits us.

    This hit home for me on multiple levels. My Mom had to declare bankruptcy in the 1990s not long after I graduated high school, and I nearly had a nervous breakdown at work over the thought of it because, in my brain, it meant her life was ruined (thankfully, my manager at the time had been in the same boat many years ago and reassured me that things weren’t as bleak as I imagined). And then there was the time 20 years ago when I lost my job and I got one of those “instant loan” checks (y’know, the ones with batshit-crazy interest rates) in the mail the very same day, and my Dad had to talk me out of cashing it. I imagine the way I felt holding that check was the same way newly-bankrupt people feel when the credit card offers roll in: desperately confused.

    Just a side comment:
    Getting a loan to go to private school is stupid, you would be the poorest kids there. Also, you can drive a coupe, rent a good place in public school and still pay much less. While private school help the elite social with other elite, it doesn’t help the avg get a better job than public school student. I know folks who graduated from Columbia University who later struggle to find entry level job.

    i was over 40k in debt (not including mortgages), and i didn’t wanna do bankruptcy. after years of borrowing and getting lucky with large influxes of cash (like life insurance), i finally couldnt keep up and had to stop paying my bills. I talked with a debt resolution company who advised me to start paying them, they hold the money, and after my accounts fall a few months behind they can negotiate settlements. Well fast forward a few months later and I couldn’t even pay for the debt resolution, so they just kept the $800 i had given them and I’m out on the street well behind on all my debts.
    took me more than a year to get back on my feet, and only due to unique circumstances was i able to start paying down what i owed. turns out you can easily enough get settlements on your own once bills are in collections, and you can usualy save 20-40% on what you owe if you can pay a lump sum. otherwise you just go back to monthly payments. It’s been two years now and I’ve wiped out more than half my debt and can actually afford my monthly bills.
    In the end it seems liek this worked out way better than bankruptcy, because te accounts become paid and dont impact your credit too much, my good history of recent payments is enough to drive my score from like 500 to the mid 600s. that said, i dont plan on utilizing too much credit in the future.

    Maybe ten or twelve years ago or so I was listening to an interview on Bloomberg Business Radio with the CEO of a large bank that owned a major credit card line. At the time there were problems with a slowdown in consumer payments of their credit card debt, and the interviewer asked the CEO if his card system could remain profitable in those conditions. In response, and probably letting his guard down a bit too much, the CEO chuckled and said simply: “Look, I’m borrowing money at two percent, and lending it out at thirty percent.” [Another sotto voce] chuckle. “I think we’re doing ok.”

    Powerful industry players change the rules of the game through back room political influence, then frame failing them as a moral failure. People fail them in droves, so a moral panic can be stirred up. This allows the introduction or even more changes, “protecting” said big industry players from supposedly irresponsible and morally reprehensible individuals (key word) bad behavior. No systemic problem is ever acknowledged.

    Just don’t ever go to school cuz you can’t get rid of student debt start companies in Delaware the first state where you have immunity from disclosing who owns the company and run the company’s build them up build credit then eventually run them into the ground and bankrupt them will not affect your personal credit and free money, Merica!!!

    I don’t know much about college tuition; I come from a country with free education. However, now that you have the system that you have with student loans and so on, wouldn’t you prefer a system where people can’t erase their debt by declaring bankruptcy right after graduating, right?

    “If you want to know the truth before you run up your credit cards and decide to stop paying make sure that you switch your address switch your phone number on file to both out of state that you live in… Also get rid of your mailbox and address markings on your house see when you don’t know comes up to you and says your name asking if it’s you don’t say yes. Walk away close the door tell him you don’t live here get off your property… Most importantly do not answer the door if it’s a cop!!! If they have enough for the warrant they can come back and kick the door in if not then they have no reason and no ability to come on into your house legally unless you open the door DO NOT open the door! Either way you must start waiting 10 years… Immediately try to rebuild your credit and let those accounts fall off don’t answer the phone to collectors or anything else and also don’t have a voicemail setup that we know we can leave messages on your phone… They can only send text and you can block the number or act like you didn’t receive it”….. All of that is some Robin Hood good for the common people illegal credit advice I got from some onetime… Just figured I would share that here.

    In my country, Malaysia, bankruptcy is not a fresh start. You end up losing many of your rights… You are no longer allowed to own a business/be a director in a company. Getting loans is also unlikely.

    The issue here is ppl not educating themselves in credit fluency. Use the system for your benefit. It is built against the regular man, but if you know how to play credit against itself within the modern US imperialist system you can trade debt on debt. If you have no credit, you can’t get credit. So let’s say you lived your life perfect without credit, living outside the system and you’ve done good, but for whatever reason you decide, let’s get a loan. Without previous credit they won’t give you a good interest rate or solid loan vs the person who miss-used their credit – it’s ridiculous. Get little credit, build it, use it, pay it off, and then take more credit. Never use cash. Always use credit – never use debit. Even Buffet will say don’t use cash. When you build small to big credit you can trade debt for debt. When you get 10k in credit you can trade it to another card with no balance fees for 18 months. Trade your debt over and over with transfer as necessary to build out the dream. If you over spend, then that’s your issue and that is because of a lack of financial literacy, but hey – the US doesn’t wan’t you to be financially literate. Borrow against nothing and move it up until you trade off for income generating assets. Take more credit and more credit and trade it over or else how are you going to beat the system and break the cycle.

    It’s one thing to say that there is predatory behavior in the financial system and call it out, which is good. It’s another to shit on the idea of taking personal responsibility for our actions.

    Most debt is bad behavior. And I say most, lest a bunch of people comment on their outlying situations that are out of their control.

    Dave Ramsey… look him up. No get rich quick schemes… just education regarding how to make a budget, follow it, pay off debts, etc.

    The Chapter 13 for the rich is a loop hole to make money and leave real life debtors face in the dirt… Because people like Trump abuse it to pay off his buddies at the top of the food chain that stipp pad their pockets with the pennies on the dollar when they look at the small contractors that actually did the work and tell them sorry there’s not even pennies for you pound salt sorry for your family. The law should look at how to spread the settlements across the board and be safe to even the little guy that get pushed aside because he would have also accepted pennies on the dollar compared to nothing… It’s the riches upside down pyramid scheme get screwed with no choice when they actually brunted the true weight of the fat cats padding their pockets on their labors…

    I used to work for a financial institution and yes a lot of the things john does say is true, but I do want to point out that there is a small percentage of people who actually abuse the “system” it unfortunately makes Banks leary when dealing with consumers.I’ve seen people ring out credit cards to the max and then suddenly file for bankruptcy, take out massive loans then file months after paying a smaller amount. I’m not advocating for the banks but there are a few bad eggs who make it worse for actually people who as jon said have unforeseen circumstances. in a unrelated note i also want to point out that when states provide unemployment which is more money depending on where you live than what people make at a normal job and people refuse to work because they get more money in unemployment which also can hamper bankruptcy or any other situation.

    This is written ASSUMING that the person reading it is John Oliver.. (well, that is the reference frame I use.. someone who isn’t John Oliver MIGHT be interested in reading it, and JO might never read it)…

    I like you as a human being…. AFTER I watched you (for the first time) on the “Last week tonight” I watched an old episode of a Brittish panelshow.. where you apparently.. oh sorry.. I mean. appeared..

    In that specific episode of that show; you kind of objected to one humorous riff trying to try to focus on “decency” and things that.. no one can REALLY disagree with IF we are talking about reality.. I am one of those people who think that there are different levels of being a decent person, AND different levels of humour, and different levels of mockery, different levels of satire.. and.. when we discuss humour.. all those are just different dimensions.. ESPECIALLY if we are talking about someone NOT wanting to laugh AT someone.. but just.. wants to find a representation of reality where they can find a giggle (without automatically judging).. if you ask me.. your response in that specific show.. (and the reason I don’t try to share WHICH episode of WHAT show intentionally.. because.. it really doesn’t matter..It’s POSSIBLE that what I say ONLY fit ONE episode of ONE specific show.. but I don’t care; What I am talking about now is how ~I~ perceive you as an entertainer.. I have NO reason to try to make the discussion of the “value” of my impression.. it just happen to BE my impression)..

    So.. you were in a show.. where you didn’t agree with what was happening.. and you DID speak out.. (without being judgemental- as I see it).. that is ABSOLUTELY okay.. but.. to me.. it means.. you.. in regards to how you want to act/think/be perceived… were on the wrong show.. so.. I actually BOTH love you, AND that show (AND the discussion that you objected to).. THOUGH.. IF!!!.. I were to take that humorous rant SERIOUSLY or as if it VALIDATED some real life claim… then I would say.. “What?.. no,.. yes SAYING it is funny.. THINKING it is funny….. but.. actually LIVING it.. or BELIEVING it.. is NOT funny.. it’s proof that you are an idiot”..

    So.. I always liked your show.. AND.. I DID like your presence in that panel-show.. BUT.. I also realized there is a discrepancy between.. “just looking for humour”.. and.. “no humour should exist that COULD be taken in a way to diminish another human being”..

    And.. yes.. I KNOW a lot of harmful humour.. that IS valid humour.. unfortunately make idiots ACCEPT that.. the “joke” is based on “the reality where there is a social judgement that will be passed on to anyone who believes in it”…

    The meaning of life is much less complicated than the actual INTENT and MEANING, and CONSEQUENCE of humour..

    But you.. are in a special Niche of humour.. and even an even MORE limited subset of “satire”…

    And.. I really really do like you.. and a LOT of the reason why I do so.. is because I actually AGREE with you..

    But as a secondary thing.. why I do NOT like you.. is because.. you look at the world using the SAME “filter”.. it’s possible.. that some things.. should be interpreted using OTHER frames of references.. and.. different goals than just the “one”..

    I identify with the things you are aspiring to.. because they are VERY important in this world.. but.. I have noticed that SOME people I have accepted into my “family”.. were REJECTED from YOUR family..

    Not to say that I think that I am always right, so the fact that there is a discrepancy between what I “agree with”.. (or even.. “accept”).. and what YOU agree/accept.. means there is a CORRECT answer..

    But.. what.. I REALLY.. want to hear from you.. is more of you explaining that something is wrong and why it is.. OR that something is right, and why it is..

    BUT.. the more complicated situations where something might not be the BEST.. and why it might not be the best.. but POSSIBLY it might be the best option in SOME situations.. and alsol.. some things are not.. “wrong”.. IF you think that LOGIC is the ONLY thing that matters.. (and yes; I personally believe in logic so this is one issue that me myself constantly get back to when I try to chose my actions, or to interprate my own previous actions or words)…

    .. well.. I apologize, but my “alarm” just told me that it’s 10 minutes before 10 pm local time.. and.. that means I should leave the internet.. I REALLY feel like my point is STILL not made.. but.. I HAVE to get my routines in order.. and.. right now.. I have to abandon being available (being in discussions),.. just so I’ll be able to relax enough so I’ll fall asleep when I have to.. so I can wake up when I should.. and do what I should before I have to leave for work.. so I get to work in time.. aaand.. so on.. so..     I MIGHT answer to people who wants to reply to this tomorrow, but as a general rule.. I TRY to look at previous discussions as if they are relics.. becuase If I assumed any debate that I had to abandone STILL should be in playl.. then.. I would NEVER come off of any one specific topic UNLESS!!.. we all agreed in the end… Whether I’d agree with ALL people I was conversing with (ẁho agree with one-and-other).. OR.. unless I chose to subdue to.. other people’s interpretation of reality.. so.. either that I REALLY learn that I am wrong.. OR!!.. that I buckle for social expectations, and just succumb to social pressure…Accepting what OTHERS think is.. “right”.

    I lost my job in the last recession caused by a gop administration. I filed for bankruptcy. My wages were so low, I qualified Legal Aide. I was able to get out from under my lemon of a car as well. I was inundated with credit card offers, personal loans and car sales. How they found out about my bankruptcy, I dont know. My credit score shot up.

    “Borrow as much as you can – we know you’ll never be able to pay it back. In fact, we’re banking on it.”

    Two degrees in international affairs, now I’m in IT.

    When you’re 18 as an undergraduate or 24 in graduate school, you only see that your tuition is covered and you might get a refund check to cover room and board.

    I went to great schools. The prestige of going to those schools justified the loans. Until reality hits.

    A degree doesn’t mean shit anymore. My IT colleagues with online courses that cost them nothing are doing just fine.

    We were lied to and conned. Anyone who went to college in America in the 90s and early 2000s knows this.

    My father could afford to put himself through college by working a part time job. I couldn’t.

    I live in Europe now, and people think I’m crazy that I have so much debt – and they are just as educated as I am. They actually find jobs in their field.

    We loan an 18 year old kid 100k to study history, and don’t think there’s a problem with that.

    The fact you can just borrow, take, use whatever you want than if it doesn’t work out just say F it is crazy. It shows how broken our systems is that you can take without having to put back in. Do people realize that money, goods, services are not free or do you just deserve them because?
